In the event that any sections of this Chapter conflict or are otherwise inconsistent with the edition of the Uniform Plumbing Code or successor code that has been or may be hereafter adopted by the City of Arcata, the provisions of this Chapter shall prevail to the extent permitted by law. Where all or a portion of any property is subject to a tenancy, the owner and tenant are each responsible for compliance with this Chapter.

No person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface, tamper with or prevent access to any structure, appurtenance or equipment, or other part of the public sewer or POTW. Any person found in violation of this requirement shall be subject to the sanctions set out in this Chapter. Except as hereinafter provided, it shall be unlawful to construct or maintain any privy, privy vault, septic tank, cesspool, see pit or other facility intended or used for the disposal of wastewater.

General Requirement. Subject to the exceptions stated in this Section, all buildings within the City of Arcata shall be connected to the POTW whenever a public sewer is located within three hundred feet of the nearest point of any property line for the property on which the building is located and the building is located within one thousand 1, feet of the public sewer. Notice shall be deemed received by the owner if the owner is served by personal delivery or three 3 business days after mailing to the last known address of the owner, or if none, to the address as it appears on the rolls of the Humboldt County Tax Collector.

The following exceptions to the requirement that all buildings be connected to the POTW apply:. Existing Systems.
